Vespera Terms of Use (User Agreement)

These Terms govern your use of the Vespera mobile application and related services (the "Services") provided by Vespera Team. By downloading, accessing, or using the Services, you agree to these Terms.

1) Eligibility (17+)

The Services are intended for individuals who are at least 17 years old. By using the Services, you represent that you meet this requirement.

2) Your Account

2.1 Account information

You may be able to create an account using a name and/or username and an email address. You agree to provide accurate information and keep it updated.

2.2 Account security

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. If you believe your account has been compromised, contact us at abcdefghijklmnopqrstuvwxyz@outlook.com.

2.3 Account termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if we must do so to protect the Services or users.

3) The Services

Vespera helps you create torn paper designs and layered collages with realistic textures and intricate details. Features may include selecting textures and colors, customizing tear shapes and edges, layering elements, and exporting creations in high quality.

We may change, add, or remove features over time. Some features may depend on device capabilities, OS versions, or network connectivity.

4) License and Acceptable Use

4.1 License

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Services for lawful purposes.

4.2 Restrictions

• Do not reverse engineer, decompile, or attempt to extract source code (except where permitted by law).
• Do not bypass or disable security features.
• Do not interfere with or disrupt the Services (including abusive automated traffic).
• Do not use the Services to violate laws or the rights of others.
• Do not upload/share unlawful, harmful, or infringing content.
• Do not create or distribute malware or engage in fraud.

5) Your Content

5.1 Ownership

You retain ownership of content you create, import, or upload ("User Content"). We do not claim ownership of your User Content.

5.2 Permission to operate the Services

To provide the Services, you grant us a limited license to host, process, transmit, and display User Content solely as necessary to operate the features you request. This license ends when your User Content is deleted from our systems, subject to reasonable technical and legal constraints.

5.3 Responsibility

You are responsible for your User Content and represent that you have the rights necessary to use it with the Services.

6) Intellectual Property

The Services and related intellectual property are owned by Vespera Team or its licensors and are protected by law. Except for the limited license above, no rights are granted to you.

7) Feedback

If you submit suggestions or feedback, you grant us the right to use it without restriction or compensation, unless prohibited by law.

8) Third-Party Services

The Services may interact with third-party services (for example, platform sharing features). Your use of third-party services is governed by their terms, and we are not responsible for third-party services.

9) Apple App Store Terms (iOS)

• These Terms are between you and Vespera Team, not Apple.
• Apple has no obligation to provide maintenance or support for the Services.
• Apple may refund the purchase price (if any) for a failure to conform to a warranty; to the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing claims relating to the Services, including product liability and regulatory compliance claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10) Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee the Services will be uninterrupted, error-free, or secure.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VESPERA TEAM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT (OR, IF NONE, US$10).

12) Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Vespera Team from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or applicable law.

13) Dispute Resolution; Binding Arbitration

13.1 Informal resolution

Before initiating arbitration, you agree to contact us at abcdefghijklmnopqrstuvwxyz@outlook.com and attempt to resolve the dispute informally.

13.2 Binding arbitration

If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration, except where prohibited by applicable law.

13.3 Injunctive relief

Nothing prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect its rights pending arbitration.

14) Governing Law

These Terms are governed by the laws of the jurisdiction where Vespera Team is primarily established, without regard to conflict of law principles, except as required by applicable law.

15) Changes to These Terms

We may update these Terms from time to time. If we make changes, we will update the Effective Date above and, if changes are material, provide notice through the App or other appropriate means. Continued use after the effective date means you accept the updated Terms.
